Page Eight: Cease and Desist
It was about this time that Barbara Tengeri introduced a new level of harassment to her repertoire. When ever she would enter the house she would begin yelling, "Get your dogs, get your dogs, I am calling the police." She would yell it over and over, day or night, whether the dogs were present or not. If the dogs were present she would go through the house (the dogs ignoring her) banging on everyone's doors, yelling, "Get your dogs, get your dogs, I am calling the police." Totally irritating.
So I decided to send her a cease and desist letter. I sent the letter (reproduced below--with full transcription following) on 5-31-08 via registered mail. A few days later the guy who works at my mailbox service said that crazy lady had been there complaining about me and the dogs, asking questions about when I picked up my mail, etc...
A few days after that I heard crazy lady yelling in the back yard, knowing my dogs were there I went to check on them. Upon opening the door I found crazy lady doing her crazy lady chant, "Get your dogs, get your dogs, I'm calling the police." I said, "No! The dogs are not bothering you, they live here, shut the fuck up." Crazy lady turned white, she was livid, she started screaming, "I'm calling the police."
I told her to call them, I was tired of her harassment. I also told her to stop stalking me. She replied, "I wanted to know who was sending me mail, I won't sign for it, you can't touch me, you hear me, I am untouchable, I was almost an Oakland police"...and other assorted non-sense.
About that time the cease and desist letter came back unclaimed, so I posted it to her door. When she found it, she was livid--"I am seeing my lawyer today, I will get you," she told me.

CEASE AND DESIST HARASSING BEHAVIOR AND SLANDEROUS ALLEGATIONS
Dear Ms Tengeri;
It has been brought to my attention that you have been making slanderous and false allegations regarding my dogs which reside at 1600 Woolsey St. in Berkeley. This is a continuation of behavior which has been ongoing for approximately 2 years. Recently you escalated this behavior into personal harassment of myself.
As you know I have 2 dogs, a one year old Cattle Dog and a 5 year old Australian Shepherd. Neither dog is vicious, nor has either ever bitten anyone. The only problem you have ever had is one of the dogs barks at you, everything else that you have alleged is a lie. Your ongoing--knowingly false--allegations have potential to cause harm to myself and/or my pets.
You have stated that you have called the police and reporting that my dog had "attacked" your grandson. I have seen documents sent by you to the rent stabilization board on more than one occasion that make the same claim, as well as numerous others. You have sent missives to the property owner making similar allegations. You have gone so far as to make the outlandish claim that one of the dogs bit you. Each of these accusations is known by you to be false and is therefore a lie.
You have also been engaged in behavior which can only be characterized as harassment. This behavior has included: purposely letting the Cattle Dog into the basement so that you could make a big show of returning her; opening and leaving open gates which are meant to restrain the dogs; provoking the dogs to make them bark; and frequent instances of yelling and threatening me.
If you believe a crime has been committed, by all means report it to the police. However, for our only contact to be you screaming at me every few days that you are going to call the police or animal control services is harassment. I really like where I live, but your ongoing harassment makes it untenable.
You admitted at the rent stabilization hearing that what you had characterized as an “attack” was no such thing and did not even involve contact or attention from the dog. While that hearing may not have been recorded and available via transcript, there were numerous witnesses to the fact that you admitted that you had made false and outrageous allegations regarding the dog's behavior. At this same time you also admitted that you had called the police and reported the--admittedly false--allegations.
I will reiterate that these dogs are not vicious, they have never bitten anyone. I take them to work with me, we visit the dog parks daily--this is not what one does with vicious dogs. Despite all of your allegations, anyone meeting the dogs would know within minutes that your claims are in fact outrageous.
I do not know what you hope to gain through these acts of harassment and false reports regarding the dogs. I do know that over the past few years I have made numerous and repeated offers of acclimating you to the dogs so they would not bark at you, each of these offers was spurned. The only possible reason I can think of for your ongoing and escalating behavior is that you are attempting to set the stage for a lawsuit regarding the dogs. Your attempting to manipulate the situation so that you can claim that someone was bitten would have grave repercussions to both myself and my pets.
This letter is intended as a demand that you cease and desist the slander and the harassment including, but not limited to, that enumerated above. In particular the threats against both myself and the dogs must end.
If this behavior continues I will take legal action to help ensure that you do not damage myself, my person, or my pets. I am willing to let the slander, lies, threats, and harassment which has already occurred go without further comment. However, any of this behavior which occurs after the receipt of this letter will be acted upon.
Should you wish to communicate with me regarding this situation, please do so in writing or in a civil tone devoid of threats.
